Former Colorado elections clerk Tina Peters is asking the state appeals court to recognize Donald Trump’s pardon of her state convictions as valid.

In a motion Tuesday, Peters’ lawyers said the Colorado appeals court no longer has jurisdiction over her case because of a Dec. 5 pardon issued by Trump. They also asked the court to release her from prison because of the pardon.

Peters, the former Mesa County, Colorado clerk, was convicted of state crimes there for orchestrating a data breach scheme driven by false claims about voting machine fraud in the 2020 presidential race.

Trump’s pardon power does not extend to state crimes.

    We can’t allow him to pardon state crimes.

    He doesn’t have that authority and we don’t need to give him more.

    If this goes to the federal supreme court, I honestly don’t understand why the state would even recognize it. It’s not under federal jurisdiction so that even they don’t have a say in this unless the state decides to just accept it for some reason.

      My hot take: She deserves to stay in jail cause she broke law and he and his team isn’t smart enough to know the lawful boundaries or they think they are above them and all must bend to their power.

        I always am, where it’s possible. The issue is, how do you rehabilitate this person? They must recognize that what they did was wrong in order to change their behavior. They believe it was right, but just don’t want to be held accountable. Fascism isn’t really something that can be rehabilitated because it’s fundamentally at odds with society.

    The Details: "Judge says “prison is the only place” for Tina Peters, who remained defiant even as she asked the court for probation " Former Mesa County Clerk and Recorder Tina Peters was sentenced Thursday to nine years behind bars by a judge who labeled her a “charlatan” for her role in a 2021 breach of her own county’s election system.

    “Your lies are well-documented and these convictions are serious,” he said. “I am convinced you would do it all over again. You are as defiant a defendant as this court has ever seen.” He added that the damage she caused is “unmeasurable.”

    Barrett also called out Peters for lying when she demonstrated her infamous videotaped attempt to kick a police officer in 2022. That incident had nothing to do with her trial, but she included it in a litany of lies she said were part of the case against her.

    She bent over and kicked a leg in the air to show how having her arm pulled had caused that involuntary movement. Barrett called that assertion “preposterous.” There was tittering throughout the courtroom over her demonstration.

      Everyone in prison should have a good reason for being there. This woman interfered with elections. That’s a big deal. She should stay in a box until she can be trusted to not do so in the future. She doesn’t sound very sorry

      A lot of people are in there just to generate money for private corporations

        She did the crime, has no remorse, and would probably do it again. Read what the Justice Barrett had to say about her.

        And yeah, it’s a stupid pithy line, but it applies to her. I’m not talking, nor was OP talking about the unjust nature of private prisons, which is well known and in need of fixing. You’ve tried to muddy the waters, by bringing up the ‘private, for profit, corporate prisons’, which is another unrelated but none the less extremely serious problem in the US today.

          It’s the stupid pithy line itself I take issue with. We have an insanely disproportionate amount of people in prison, we can’t be dismissing prisoners as deserving to be there

          I just think repeating that line is bad for society. It doesn’t matter if it applies, it’s an anti-society meme

Do you think my repeating that ‘pithy line’ is anywhere near as bad as the crimes that Tina Peters has been convicted of? It seems like you are hung up on this one line, and ignoring Peters’ crimes, which are the subject of OP’s post. Would it make you happier to make another post about the horrible nature of the private prison system in the US? It certainly would be more effective in furthering your goal of bringing attention to the problems posed by private prisons.

      I’m not saying you’re wrong, it’s the line itself I take issue with. I think using it is harmful to society in some small way. I think you don’t mean it to be, it’s a meme. It sticks in your head and comes out at opportunune times

      I just think it’s an anti-society meme. I think it’s bad, and that we shouldn’t spread it, but instead we should react negatively to it
