In theory, there would need to be a clear national emergency, such as a ground invasion of the United States or open rebellion to allow for martial law to be declared.
I don’t think Iran is going to launch an amphibious assault against the United States any time soon.

Conceding on this AT ALL gives them leverage.
Every US soldier that is neutralized in Iran will not be there to fight in another unjust war… so, my sympathy to those people is limited.
